Terms of Service

Effective October 15, 2026.

These terms govern your use of ashrybenconsulting.com and any purchase of the Financial Assessment or related services from Ash Ryben Consulting Inc. ("ARC", "we"). Using the site or purchasing a service means you accept them. An engagement agreement signed by both parties controls over these terms where the two differ.

1. The service

The Financial Assessment is a fixed-fee analysis of the personal and business financial information you provide, resulting in a personal financial statement, a consolidated debt schedule, per-entity and per-property analysis, identification of a primary financial roadblock, and one to three recommended strategies with implementation playbooks, delivered in a workbook and reviewed with you on a call. Execution engagements are scoped and priced separately in writing.

2. What the service is not

3. Your responsibilities

4. Fees and payment

The Financial Assessment fee is stated on the site and in your engagement agreement, payable in full before work begins unless otherwise agreed in writing. Execution engagements are invoiced per their written scope. Fees are for professional time and analysis and are non-refundable once work has started, except as provided in section 5.

5. Satisfaction and cancellation

You may cancel an assessment at any time before you submit the intake for a full refund. After submission and before delivery, we'll refund the fee less $750 for work performed. If, after the proposal call, you believe the assessment did not identify a roadblock or deliver the strategies described, tell us within 7 days and we'll either revise it or refund the fee. We'd rather fix it than keep money for work you don't value.

6. Confidentiality

We treat everything you share as confidential, use it only to perform the services, and share it only as described in our Privacy Policy or as you direct in writing.

7. Intellectual property

Our models, templates, methods, and site content are ours. Your data is yours. Deliverables built from your data are yours to use; the underlying model and methodology remain ours.

8. Limitation of liability

To the fullest extent permitted by law, ARC's total liability arising from the site or any service is limited to the fees you paid for that service, and ARC is not liable for indirect, consequential, special, or punitive damages, including lost profits, lost financing, or credit consequences, even if advised of the possibility. Some states don't allow these limits; in those states they apply to the extent permitted.

9. Disputes

These terms are governed by Florida law. Any dispute will first be raised in writing and discussed in good faith for 30 days. If unresolved, it will be decided by binding arbitration administered by the American Arbitration Association in Hillsborough County, Florida, on an individual basis; either party may instead bring a qualifying claim in small-claims court. You and ARC waive jury trial and class proceedings to the extent permitted by law.

10. Site use

Don't misuse the site, submit false information, attempt to access data that isn't yours, or interfere with its operation. We may suspend access for misuse. The site is provided "as is" and may be unavailable from time to time.

11. Changes

We may update these terms; the effective date above will change. Continued use after a change is acceptance. Changes don't alter an engagement already in progress.
